Pagestead OÜ, registry code 14453343, located at Sepapaja St. 6, Tallinn 15551, Estonia (hereinafter "Pagestead", "we", "us" and "our") is providing a professional website building solution to its clients and to their clients via website

Pagestead respects the privacy and is committed to protect the personal data that client shares with Pagestead. Therefore, we consider necessary to inform the clients about data being collected, the purposes of such collection, requirements for retention and rights related to the processing of the personal data.

This privacy policy applies to personal data processing which is conducted in relation to a client who is a natural person (hereinafter "Client""). If the Client does not agree with any or all terms of this policy or any possible changes to it, the Client should immediately close the website and cease using the services provided by Pagestead.

Pagestead has the right to unilaterally supplement and/or amend the privacy policy from time to time. We undertake to notify the Client about such changes.

1. Personal data being collected

Pagestead processes the following data about the Client (hereinafter “Personal Data”):

  1. Identification data: e-mail, address.
  2. Payment data: card number, account holder name, bank name, expiry date of the card, purchase details, CV code.
  3. Service related data: purchase details (incl. package / license type, license key, purchase date and time), number of packages, sites and users on system, current software version, created and modified timestamp, last login timestamp, GithubID, IP address.
  4. Other data obtained by the use of the website: Client’s correspondence with Pagestead, inquiries submitted in the website or via e-mail and Client’s activity logs. For further information please see also section 7 below.

2. Legal basis for the processing of Personal Data

Pagestead may process Client’s Personal Data under the following legal grounds:

  1. Under terms of service entered into with the Client for the provision of service;
  2. Under explicit consent granted by the Client, if Client has requested to receive Pagestead newsletter by e-mail;
  3. For the fulfilment of legal obligations to which Pagestead is subject to;
  4. Upon legitimate interests pursued by Pagestead. Our legitimate interests are to ensure that license is used according to the license terms, to manage Pagestead Client resources, to improve our service, contact you via e-mail and monitor and improve information security of Pagestead website.

3. Purposes for collecting and processing Client’s Personal Data

Personal Data collected by Pagestead is processed for the purposes established in the law or as described herein, including but limited for the following purposes: to provide Pagestead service (incl. to provide license and payment processing); to provide access to Pagestead support system, to resolve your requests submitted to our support, to ensure the license terms are adhered to, to manage, analyse and improve our service; to contact the Client for administrative purposes such as customer service, address technical or legal issues related to the service provided, or share updates and notifications about the service; to send relevant marketing information to the Client about our services, if the Client has granted an explicit consent to use the Client’s Personal data for such purpose.

Pagestead shall not use Client’s Personal Data for any other purpose incompatible with the purposes outlined above or required, permitted or authorized by law.

4. Transfer of the Personal Data

Pagestead may transfer Client’s Personal Data to third parties, such as third party service providers who help us to provide Pagestead service (e.g. web hosting service provider, payment processing service provider, cloud service provider, service providers helping to integrate different web applications and providers helping to create, send and manage marketing campaigns), regulatory authorities, accountants, auditors, lawyers and other outside professional advisors. Pagestead has taken steps to ensure that these data recipients protect the confidentiality and security of Personal Data, and to ensure that Personal Data is processed only for the provision of services and in compliance with applicable law.

Such third parties may be located in countries outside of the European Economic Area (“EEA”) whose privacy regulations may differ and which are not subject to adequacy decisions of the European Commission. In those countries the security of the Personal Data (inc. protection against misuse, unauthorized access, disclosure, alteration or destruction) may not be ensured as it is secured in the European Union, due to the lack of adequate data protection level.

For example, Pagestead may transfer Client’s Personal Data to US, in which case Pagestead shall ensure that the recipient of the Personal Data is certified in accordance to the EU-US Privacy Shield entered by and between the U.S. Department of Commerce and the European Commission. When transferring collected Personal Data outside of the EEA, Pagestead shall ensure the application of the appropriate safeguards. If the Client wishes to receive a copy, please contact us as instructed below.

5. Security

Pagestead will take appropriate legal, organisational and technical measures to protect Personal Data consistent with applicable privacy and data security laws. Security measures shall be applied in order to protect Personal Data from involuntary or unauthorized processing, disclosure or destruction. Recipients have been made aware that Personal Data may only be used in accordance with the purposes described in this notice.

Client’s Personal Data is only accessible to authorized persons, who are bound by confidentiality obligations.

6. Integrity and retention of the Personal Data

Pagestead will retain Personal Data for the period required or permitted by applicable law, but no longer than it is reasonably necessary in order to achieve the purposes for which the Personal Data was collected. At the latest Client’s Personal Data shall be deleted upon expiry of the Client’s subscription period, unless Pagestead has a legal obligation to store Client’s Personal Data for the certain period specified in the law or if the processing is conducted under the explicit consent of the Client.

Pagestead takes reasonable steps to ensure that the Personal Data we process is reliable for its intended use, accurate and complete as necessary to carry out the purposes described herein.

7. Client’s rights in regarding to the collection of Personal Data

Client has the right to:

  1. request access and/or corrections to Client’s Personal Data collected;
  2. have the Personal Data erased, removed and/or transferred from our active files in line with provisions of applicable regulations;
  3. request restriction of processing of Costumer’s Personal Data or to object to such processing;
  4. receive the Personal Data concerning Client in a structured, commonly used and machine-readable format where technically feasible;
  5. raise concerns about the handling of Costumer’s Personal Data to us;
  6. lodge a complaint with the Estonian Data Protection Inspectorate, if Client considers that his rights have been infringed;
  7. withdraw consent for the processing of Personal Data, where the Personal Data is being processed on the basis of the consent, without affecting the lawfulness of the processing before the withdrawal.

In order to exercise any rights referred herein the Client is required to submit a written application to Pagestead. Pagestead has the right to decline such application by justifying the reasons for the refusal.

The collection of certain Personal Data referred herein may be required under the law and/or inevitably necessary for the provision of service to the Clients (such as data necessary for the verification of the Client). Failure to provide data may result in adverse consequences, such as, our inability to comply with our obligations under law. The Client is welcome to ask clarifications regarding the obligation to submit any specific Personal Data and also about possible consequences arising from the failure to provide such the Personal Data.

8. Cookies and tracking technologies

Pagestead may use third-party analytics tools which may use cookies, to help us measure traffic and usage trends for the Pagestead service. Web analytic service provider analyses the usage of the Pagestead website and services so that Pagestead could improve and amend our website and function thereof.
